FirstDibz.com Scam Rip-Off Fraud Headquaters - www.superbowlexperts.com

Okay so at some more time looking around on the Internet and this firstdibz situation seems to be widespread, with estimates of around 400 people being affected and thousands of dibz being unwillingly voided. At this point, each dibz is worth over $250, so there is a lot of money at stake.

FirstDibz.com is a scam.
Firstdibz.com does not honor their guarantee.
Firstdibz.com violates their own "no refund" terms of service.
Firstdibz.com has ruined the plans of hundreds of people, and has taken away what is rightfully theirs, assets worth potentially thousands of dollars.

They nabbed 10 Steelers from me that I bought on 12/29 and 1/1. Total refund was about $2200. I just sold two ACTUAL Steelers Firstdibz for $750 per, so that's a value of about $7,500 for the ones they seized. They tell me I'll be refunded for some Vikings, Colts, and Dolphins that I owned also. All these refunds together won't come close to what the true value of the 10 Steelers they seized would be worth.

I finally got someone on the phone after countless emails and phone calls. The guy said that two individuals ran a scam over this past weekend (Note: well after I purchased the Dibz in question). I reminded him of FirstDibz obligation to try to find me tickets if the Steelers win, and he said the fraud was too widespread for them to be responsible. I had some other teams that went to zero that he said were legit and I wouldn't be refunded. I asked "So, I guess I just have to take your word about what I should be refunded for and what I shouldn't?" and he said "Yeah, basically."

You all are right though, a refund isn't acceptable. I want my 10 tickets if the Steelers win this weekend.

I'm very much in favor of a class action suit, and am willing to help vet law firms that would be willing to take the case.

Exactly what I paid. $219 each plus the 7% buyers fee. Total for the 3 Dibz was $702.99

Depends. Similar Dibz were selling for around $800 each at the time I received the email notification. If the Steelers advance to the Super Bowl, broker prices for Club level seats are ranging from around $3000 to over $10,000 each depending on exact seat location. It is safe to estimate it will cost me a MINIMUM of an extra $1800 per seat.

- Sorry you are not eBay and Stubhub, your an future and option trading platform where the value goes up and down. When my team loses they have taken my money, when my team advances they offer a refund. Total bull. I even tried to get a refund on teams that are still alive since I don't trust the company and know they will refund me if they win and STEAL my money if they lose. No Dibz

Phone always goes straight to voicemail. Multiple email with no response. I have withdraw all my funds and file chargebacks on ALL purchases with them. You can't just take my money when it's benefits you and refund me when my value goes up.

If they do not fixed the situation, we will issue the press release to the 50 major market newspapers and news organization. These news organizations have run nice stories on this company in the past and have steered customers to them. I'm sure they would want to know about this mess.

I was then called by fufillment department because i have been buying and selling dibz all year and i have dibz out on a team still in. I thougt it was ironic they were calling to make sure i was gonna fill my tickets when they arent going to fill theres. the funny thing is they made it sound is if they were all going to a bar to watch the game and pray for philly. im sitting still currently cause i have 15,000 in my account and want to make sure i can get it out. but if arizona makes it to the superbowl, i will most likely seek legal council.

Look at Stubhub sold for 300+ million dollars , they have the stub hub guarantee , thats why we all have bought there because we know if we go and buy , our order is good. look people are ignorant the price of the dibz i bought that got canceled for the cardinals was 30.00 each back before the playoffs started when no one gave them a chance. if i had bet the 30.00 on the cardinal to beat the falcons i would have had 85.00 after my moneyline bet then if i put it on them again to beat the panthers at +375 moneyline i would have converted it into 403.75. now if i was to rebet it on the cardinals at +170.00 against the eagles and the cardinals win my new total would be right about 1188.00 i would cash that out and find a ticket pay that 1188 add another 800 for the face value and bam i got my ticket . i know whjat im saying i hope someone out there understands what im saying. the problem is ticketnetwork gambled and did not hedge themselves and now are worried of what might happen
they can easily use the funds that the "fake sellers" made that is frozen in there accounts to buy the superbowl tickets the difference would not be that big since they sold many teams.
finally in closing have all the san diego fans that only bought san diego dibz and lost there money and are clueless to the situation been refunded??? funny most of my active dibs where fake but only 3 sets of like 30 sets of my losers were fake hummm makes you wonder

you see guys the tricky part here for first dibz is that the fradulent sellers might have bought some of the dibz themselves via another person . that turns this into a real big confussion . hopefully they keep track of ip addresses and then track things backwards and really investigate it .I really hope the culprit frys in prison for fraud because if i find him he wont like it. guys first dibz has alot of work cut out for them

I already "Lost" all my 12 Steelers and Cardinal tickets and 2of my Ravens tickets. Now on 1/15 I checked the rest of my ticket options and now 4 more of my Raven ticket options are gone. That completes it...all my tickets are now "Gone".

They need to compensate their customers and then go after the fraudsters. They need to honor their guarantees like Stubhub or turn out the lights.

As this is the first Super Bowl to employ a uDIBZ market, there is some trepidation about using the service, which is keeping the prices lower. When a seller does post large quantities of DIBZ for sale, we always contact that seller and verify their ability to produce the tickets.

If for whatever reason the seller cannot produce tickets and FirstDIBZ is unable to produce equal or better seating, you will be reimbursed 125% of the final selling price of the DIBZ. Again, with that being said, such a contingency has not occurred.

All sellers must complete and sign our “Seller’s Agreement”, which is a legally binding document ensuring that users do not post tickets to which they do not have access. In the event that they (for whatever reason) are unable to produce said tickets, FirstDIBZ purchases equal or better tickets for the end buyer on the secondary market. We then have the right to charge the price of those tickets to the original seller who could not produce tickets. We have further indemnification options as well.

With that being said, we have never had a seller list tickets to which they do not have access.

I sure hope they settle. Afterall, not accounting for the fraudulent dibz transaction fees, they've made over $1,900 from my other purchases and sales in trans fees.

As for the 846.60, that's taking everything into account. Basically, I was left with Zero fraudulent dibz in my posession at the time they started reversing things...so everything was all settled on the money front at that point. Then they reversed all the transactions (some positive, but mostly negative becuase of the sales I made for a profit) related to the Dibz and subsequently subtracted that amount from my account.

Just a couple of points...

1. For those of you that don't think they have the finances to make appropriate reparations... FirstDibz (formerly TicketReserve) announced a strategic partnership with CBS in 2007. At that time CBS became a minority investor in TicketReserve and stated an interest in working together for online and offline business promotions/activities. You can look up these announcements by typing "Ticketreserve and CBS" in a Google search. The invested amount was never disclosed, but it is doubtful that a major corporation would make a major announcement like that for an insignificant investment.

2. The reparation plan that FirstDibz states they will announce on Tuesday (after the AFC/NFC Championship Games) may not satisfy many consumers adequately. For example, I bought some Cardinals Dibz and was planning on selling most of them today. The going rate is ~$300-400 depending on the location of the seats. This was going to be my "insurance policy" in case they don't win on Sunday. I would have at least left with some profit, if not the actual Super Bowl tickets. Now if they lose the NFC Championship game I may not get anything at all, since the market will be officially closed without having to fulfill the Super Bowl tickets.

3. Lastly, I agree this is the biggest screw up this company has made thus far. However, it is far from being the only error they have made that adversely affects its consumers. Another example is how they have treated the NCAA Final Four market in the past. Approximately 2-3 years ago they initially opened up a "Upper Level" market for the Final Four. Months later they suddenly decided to open up a "Lower Level" market for the same event, which nearly ended any demand for the Upper Level seats and sent the market prices crashing. They immediatlely received many complaints that this kind of move adversely affected fair market conditions and left a lot of their loyal customers (those that buy early and often in a market) with a lot of reservations without any demand. They were told that they should announce at the initial offering that later markets may be released for the same event; otherwise, the company could always manipulate market conditions by adding to an event market and effectively take away the fair market conditions they were promoting. To make up for this they upgraded all the initial "Upper Level" reservations to "Lower Level" reservations, and then opened up the market to the general public. Unfortunately, a year later they then did the same roll-out of different levels of seating for the same market event without any prior notice. This time they did not feel the necessity to make any reparations and instead left a lot of people angry. This is just one of many customer relation errors they have made... I can list many more!!

I have used this site for ~4 years now, and have noticed that as they have tried to grow their business and profit margins their business model and practices have become more and more shady. With this their customer service has really suffered and some of their most loyal customers (like me) are becoming more an more disgruntled. I have probably spent over $50,000 on this site in the past few years... If they don't fix this quickly and satisfactorily I am definitely never going back!! In fact, I'm not sure I'm going to use the site anymore regardless of what they do. This is just the latest in a number of blunders and poor customer service by this company. I AM STRONGLY IN FAVOR OF MANY PEOPLE SUBMITTING COMPLAINTS TO THE FEDERAL TRADE COMMISSION & BETTER BUSINESS BUREAU IF THIS IS NOT HANDLED QUICKLY AND APPROPRIATELY!!

Just wondering, is anyone else NOT receiving the "Your Order Has Transacted" emails? I've sold some things since the story came out, but the last email confirmation I received was on 1/14. With the discrepancies in some of the stories (i.e. them saying that these fraudulent dibz were only sold late at night, though we know that is not true and can verify with these emails), I'm wondering if they are eliminating future paper trails. I just don't trust them anymore.

I received one of these insulting lowball offers on the Dibz I currently hold - $1000 total to buy out positions on 10 tickets, mostly lower levels. It's becoming increasingly obvious that they don't have the tickets and are doing everything in their power to avoid having to cover their positions on the open market. They've even set their earliest pickup time past the SH delivery deadline to make it even more difficult to resell any tickets they are obligated to fulfill.

Okay, put the whole original scam aside. Now the Premium Club seats I paid 400.00 per dibz a couple weeks back are now being pulled even after they said they were verified and NOT PULLED THE FIRST TIME..These were in my Items won. So now I have lost everything and superbowl tickets that were even verified after the original scam and now they tell me tonight..Are you kidding me...I want MV for these and thats 5K a ticket...I am sooooooo upset. Looks like they are doing "everything" they can to make this an "experience". This was posted on TicketNews.

I lost Dibz last week on the Eagles but had "verified" Dibz still alive on you guessed it, Arizona. I booked everything last Sunday and Monday to save money on travel (pre-paid guaranteed), just like so many others. Tuesday, the contrary to established policy email arrives. Odd thing happens when you try to back out of a transaction for travel expenses. Those companies must have a different dictionary definition of guarantee. I held off on booking some other activities and events until, you guessed it again, yesterday because I had Super Bowl XLIII in my "DIBZ WON". They have thrown around assurances in customer service and used the word guarantee within their web site. I confidently look forward to their meeting or exceeding the experience I have come to know at their company. Yes, I am writing this because the "reparations" email I received was incredible. I had a different understanding of the term reparations. If you have not received an email yet it means, "remove" because they took away my Winning Dibz. I told my friend he was going to the Super Bowl last week. Guess what word I used this week after the game was final and I had Dibz Won? Oh no, I forgot to ask for their definition of met or exceed.

i bought 2 steelers Dibz during the 4th qtr for over $500 for the upper deck. they said i need to pick up the tix in tampa. i said they are crazy. they will not ship them to me....probably because they do not have the tix yet. they offered me 150% of the purchase price to NOT pick up the tix, and they would buy my options back.

if anyone has a lawyer, let me know as I would like to be involved in a class action lawsuit. This company os an absolute joke.

In response to the fraudulent activities by a group of outside individuals who violated our Buyer Agreement and Seller Agreement by placing tickets for sale in our uDIBZ Super Bowl XLIII market that they did not possess, FirstDIBZ offers the following terms to you:

Proffered Terms

1. FirstDIBZ will refund all costs associated with the fraudulent uDIBZ activities. This includes teams that have been eliminated. (This may have already occurred) Value: average $129.
2. FirstDIBZ will fund your wallet $250 for each of your fraudulent Steelers and Cardinals uDIBZ contracts, up to 4 (EX: 2 Fraud uDIBZ = $500, 4 Fraud uDIBZ = $1000)
3. In addition, FirstDIBZ will give each Steeler and Cardinal fraudulent uDIBZ holder a $100 FirstDIBZ credit per uDIBZ (unlimited) for usage at your discretion on FirstDIBZ.com.

Legal Release

In consideration of FirstDIBZ' undertakings as set forth in this agreement, the receipt and adequacy of which are hereby acknowledged, Customer, for himself and its/his employees, agents, consultants, experts, representatives, and attorneys, as well as all other natural persons in its/his employ or otherwise acting or purporting to act on its/his behalf, releases and discharges FirstDIBZ and its present or former owners, directors, officers, employees, agents, consultants, experts, representatives, and attorneys, as well as all other natural persons in its employ or otherwise acting or purporting to act on its behalf, against any rights, duties, obligations, claims, causes of actions, demands for payment, or any other action, known or unknown and that presently exist or that arise in the future, concerning, arising from or in any way related to tickets to Super Bowl XLIII through the uDIBZ Marketplace or the right to purchase or obtain any such tickets through the uDIBZ Marketplace, including but not limited to any claims involving "DIBZ" possessed at any time by Customer through the uDIBZ Marketplace in connection with such tickets.

It is understood that this release shall be and remain in effect as a full and complete general release notwithstanding the discovery of different or additional facts. Customer acknowledges that he has been advised by legal counsel and is familiar with the provisions of California Civil Code Section 1542, which provides as follows: A general release does not extend to claims which the creditor does not know or suspect to exist in his or her favor at the time of executing the release, which if known by him or her must have materially affected his or her settlement with the debtor. Customer is aware of said Code section, and hereby expressly waives any rights he may have thereunder, as well as under any other statutes or common law doctrines of similar effect.

Electronic Signatures Disclosure: By electronically signing this agreement you acknowledge and agree that such electronic signature is valid evidence of your consent to be legally bound by FirstDIBZ. You accept notice by electronic means as reasonable and proper notice, for the purpose of any and all laws, rules and regulations. The electronically stored copy of this agreement is considered to be the true, complete, valid, authentic and enforceable record of the Agreement, admissible in judicial or administrative proceedings to the same extent as if the documents and records were originally generated and maintained in printed form. You agree to not contest the admissibility or enforceability of FirstDIBZ electronically stored copy of the Agreement.

re: the previous NCAA upgrade. That was ~3 years ago. I think it was the first year they came with the lower level seating. I believe it was the year LSU went to the final four (around the time of Big Baby). I'd have to look at my records to be sure.

Please do not sign that "consumer satisfaction agreement". I received the same one. That is essentially just a liability release form, which they want you to sign so they can avoid being sued. There is some compensation involved, but it is minimal!! Do not sign. I am going to organize a class action lawsuit and will keep everyone updated on the status via this and other blogs.

I just logged in to find my balance has decreased once again. I posted earlier that I had lost $846.60 due to the reversal of transactions. This was after all of the remaining uDibz were verified. Well, I just logged in this evening to find that now I've lost a total of $4,697.60.

So my total loss on paper profits is about $4000 + 2 lower sideline seats for Steelers. I also DID NOT sign the agreement. From what I know, every single transaction from udibz are taken away, so they are basically saying that every one of them are Fraud? haha they are just trying to take back as much as they can to cover for their future lawyer fees, they know that they will have to face many lawsuits, so people, DO NOT SIGN THE AGREEMENT! They know we have a good case here that's why they are offering us $250 right away. For me, it is no longer the money loss I am mad at, it is the way they run the business and they way they are just taking money away from us when they verbally and written "guaranteed" our funds

As our investigation continues and we assess the impact of the fraud that victimized our users, we have had to take many steps to protect our users and to insure that no funds whatsoever get to those who have perpetrated this fraud.

Based on the terms of the FirstDIBZ User Agreement and Seller Agreement, and the company’s policies and procedures, we have “unwound” all transactions associated with ALL fraudulent uDIBZs. This includes transactions by those of you who purchased fraudulent uDIBZ, and subsequently resold them, both for teams that made the Super Bowl and teams that were previously eliminated. This means that we have refunded to your wallet:

The original price you paid for any fraudulent uDIBZ
The transaction fees you paid associated with buying any fraudulent uDIBZ
The transaction fees you paid associated with selling any fraudulent uDIBZ

Once we have properly identified and isolated the wrongdoers and completed all necessary investigations, we intend to further communicate with you. Given the complexity of the matters, we do not envision this outreach occurring prior to this weekend's Super Bowl.

I have purchased options for several teams in the NFL for the past 4 years so that if that team made it to the Super Bowl according to their website I would be guaranteed the option to purchase a Super Bowl ticket at face value for every option I owned for those teams. This year alone I spent just about $1,300 in options for various tickets. The following week of playoffs I had options for the NY Giants, Arizona Cardinals and Philadelphia Eagles which guaranteed me 2 Super Bowl tickets since they were the only remaining teams in the NFC. Since it looked like a lock I did not attempt to sell of any of my remaining options. If I did not have what appeared to be guaranteed Super Bowl tickets I would have sold off my remaining options and purchased tickets on my own. I still owned Giants options which were selling for approx $850 a piece and up and San Diego options which were going for around $350 each and up. Conservatively I could have sold them for around $2,400.00 total. But I did not because I thought I had my tickets guaranteed. The following Wednesday Jan 14th I received an email from First Dibz telling me the Arizona options I had were no good. Here is the jist of the email I received from them. " FirstDIBZ is sending you this very important email because it has come to our attention that an individual uDIBZ seller has misused the FirstDIBZ website (in contravention and breach of the Seller Agreement). As a result, this individual has had their account suspended to protect the integrity of the overall uDIBZ marketplace. FirstDIBZ has accelerated its activities in finding any sellers that are misusing the marketplace and will continue to do so until all sellers are 100% verified. During the seller's misuse of our website, our records confirm that you have purchased DIBZ from this individual and as a result we will be refunding you 100% of the amount you paid for these DIBZ plus 100% of the transaction fees that were incurred." Since then they said my Philadelphia, Arizona, Indianapolis and Miami options were no good. They only options that were still good were my Giants and San Diego options which I would have sold if I had known this sooner. Both of these teams were now out of the playoffs. I have written numerous emails and left a dozen voicemails with the company to explain my prediciment but all I recieved was a refund of my money plus fees for the bad options. I feel that there should be more of a compensation for all the money I lost because of their failure to properly screen sellers who are posting these options on their website. Super Bowl tickets face value are between $700 and $900 but if you try to buy them from anywhere you are going to spend at least $2,500 - $6,500 a piece depending where you are sitting. The options I had for Arizona were for lower level sideline seats which start at a minimum of $4,500 a piece. I would have had 2. Worst case scenario I should have had the $2,400 I lost by not selling the other options and I could have at least purchased 1 of my tickets when I got down to Tampa. Now I have no tickets and no money to even purchase tickets. I will most likely have to cancel my trip which is a story in itself. Since this whole thing started 2 weeks ago FirstDibz.com had changed it service agreement online and removed the word guarantee from everywhere. They use to say if you own the dibz you are guaranteed the right to purchase the tickets to that event at face value. They are asking everyone to agree to their new agreement by Jan 27th or you will not receive the credit they are offering ($250 per dibz for Arizona or Steelers options that were bad).

I can now say that there is more than a class action lawsuit against them there will also be discrimination lawsuits filed due to the fact they have made different offers to different people. based on there needs. and they have given some people tickets to the super bowl to get them out of there way. I have names and phone numbers . they even madeone person sign an agreement to not use there site again. makes you wonder who the real frauds are???

I have a class action lawsuit that was just signed. The lawyers feel that this is a great opportunity to win, and recover much more money than firstdibz is offering. If you sign their reparation agreement, you will not be able to partake in the class action lawsuit. You have to do what is best for you, but know that there is an option and you do not have to agree to their flimsy plan, which is more of an opt out clause than an award. If you ahve any info of any plan they offered you outside the repararion agreement, please post anonymously. Thanks.

Loyal fans looking for tickets to the big game can forget about dealing with scalpers, thanks to a new company allowing them to bid on tickets for their favorite teams.

Ticket Reserve operates as a futures market, allowing fans to place a bid on their team's tickets for a big game on its Web site, www.FirstDIBZ.com. The market, operating on the basis of probability, determines the price of the bid. By purchasing this reservation, called a Fan Forward, passionate fans are guaranteed access to a ticket, at face value, if their team makes it to the Final Four.

"It's not some kind of shopping cart that we're manipulating," said Robert Hamilton, vice president of marketing for Ticket Reserve. "It's the market just doing what it does best."

For example, if a Duke fan wanted to reserve tickets at the beginning of March Madness in the event of the Blue Devils going to the Final Four, they could place a bid. A fan from George Mason University could do the same. Since Duke was a heavily favored team, the market may have valued the Duke Fan Forward more than the GMU one. But if a dedicated Patriot fan placed a bid early on, he could now redeem it for the option to buy Final Four tickets at face value - likely at a much lower cost than trying to buy tickets from a third party.

"We have some people this year who bought a Fan Forward for George Mason," said Hamilton. "They may have bought ticket rights for $5, thinking that this was the year the stars were aligned in their favor. By purchasing this reservation early, they now have the chance to buy Final Four tickets to see their team at face value."

Of course, the system can be used by more than just devout fans. At any point in the process, a Fan Forward holder can option out and sell the ticket.

"To stick with the George Mason case, this guy who bought the fan forward for $5 now might say, 'I want to let go of it for, say, $75,'" said Hamilton. "Someone else out there might determine that they're willing to pay $75 for a chance at tickets. So the original holder could sell it at a substantial profit."

The company can offer ticket opportunities because it has worked out individual deals with distributors who promise to share the revenue from the tickets. Hamilton sees this as "the model of the future."

"In the revenue sharing deal, everyone's a winner," he said. "Fans win, because they get to see their favorite teams. We win, because we earn money off the tickets. And the rights owners win, because they can charge a fee for each ticket sold."

In an era when a Super Bowl ticket can fetch thousands of dollars, Ticket Reserve believes it can not only offer fans a better deal, but help cure some of the corruption involved.

"Everyone stands to benefit when we can take back sports from a lot of the greedy forces that have overtaken them," said Hamilton. "We're not trying to be overly rebellious here, but we do feel like we offer a much better alternative."

Ticket Reserve was founded in 2001 by Rick Harmon and Herb Rudoy and originally just offered the futures market model for Super Bowl tickets. Since then, it has grown to include everything from Indy car racing to the NHL - and yes, it must be said in March - college basketball.

"George Mason was definitely the big story this year," said Hamilton.

Ticket Reserve also touts as one of its advantages its high security. Unlike scalpers, who can easily scam unknowing victims, Ticket Reserve is fully legal and guaranteed.

Hamilton won't say exactly where Ticket Reserve is looking next, but he sees a lot of potential in the model.

"The model for how seats could be allocated plays very well where there's other sports with very high demand," he said.
